The Right of Children to Free and Compulsory Education
Act – 2009 (RTE Act – 2009)

The Parliament of India has been enacted the Right of Children to Free and Compulsory Education Act – 2009 for the beneficial of the children aged from 6 years to 14 years. This was enacted by the Article 21 (a) of the Constitute of India under the declared provisions of the Articles 29 and 30 of the constitution.

The Functions of the Right to Education Act – 2009

  1. Right to child to free and compulsory Education
  2. Special provisions for children not admitted to, or who have not completed, elementary education.

The Government of Kerala has been enacted the Kerala Rights of Children to free and Compulsory Education Rules – 2011 by the power informed by the section 38 of the Right of Children to Free Compulsory Education Act – 2009. The Kerala State Commission for the Protection of Child Rights empowered to protect to provisions envisaged in both RTE Act – 2009 and Kerala RTE Rules 2011 for favour of the Rights children. The Public or any aggrieved person an approach the Commission for the restatement for the breach of Rights of children.

Right to Education Act (RTE Act) – 2009

The Right of Children to free and Compulsory Education Act or Right to Education Act (RTE) is an Act of the Parliament of India enacted on 4 th August 2009, which describes the modalities of the importance of free and compulsory education for Children between the age of 6 to 14 years in India under Article 21 A of the constitution of India as well as the provisions in the Articles 29 and 30 of the constitution.

The Relevant Provisions in RTE Act – 2009

  1. Maintain regularly and punctuality in attending school
  2. Complete enter curriculum within the specified
